Mistrial Announced As To 1995 Death Case
A mistrial has been affirmed in the case of a man accused of beating a Saint Helena Island man to death in 1995. Circuit Judge John Breeden declared the mistrial Tuesday after it was single-minded several jurors had read a newspaper article that included information on a pre-trial hearing. Richard Simmons, 43, is charged with murder and first-degree burglary in the clubbing death of 58-year-old Charles Godley. The article mentioned a videotaped confession, the subject of the pre-trial hearing. Defense attorneys said the declaration of guilt was coerced because Simmons was under the influence and had been provided beer by an undercover investigator.
